Mirella Peletier has a broad civil law advisory and litigation practice, with an focus on government privilege law, real estate and cassation.
Within the cassation specialism, Mirella advises and litigates on the entire field of property law, with an emphasis on general property law, contract law (including tenancy law), insolvency law, relationship property law and inheritance law.
Over the past decades, Mirella has built up an extensive track record in cassation practice. She successfully handled a variety of cassation cases, both for plaintiffs and defendants and in both claim and application proceedings. She also regularly assisted civil society organisations as speakers in preliminary ruling proceedings before the Supreme Court.
Part of her practice is advising lawyers who litigate on appeal. Possibly also with a view to future cassation proceedings. Experience shows that a well-chosen approach on appeal increases the chances in cassation.
In her work, Mirella uses her experience as a court auditor at the Supreme Court and her academic background. She obtained her doctorate in 1999 with a dissertation on discretionary powers of amendment in contract law (Rechtlijke vrijheid en partijautonomie, Boom Juridische uitgevers).
Mirella is a deputy judge at the Amsterdam Court of Appeal. Mirella enjoys sharing her knowledge of civil procedural law with fellow practitioners as a lecturer. She publishes regularly and is a member of the core editorial board of Opmaat Huurrecht (Sdu).
Mirella is member of the Civil Cassation Lawyers Society (VCCA).
