Mark West

Senior associate

Mark specializes in environmental law, zoning law, government compliance and government sanctions. He represents municipalities and private-sector parties in complicated development cases involving residential housing projects and real estate transformation projects. 

Mark also advises and represents clients in litigation and mediation relating to environmental law, energy law, pharmaceutical law and railway legislation, including permitting issues regulated by public law. Furthermore, Mark advises and assists other law firms with the environmental, spatial planning and zoning aspects of major M&A transactions.

Mark frequently publishes in legal journals, e.g. AB Rechtspraak Bestuursrecht (Kluwer) and De Gemeentestem (Kluwer). He is co-author of Commentary on the General Administrative Law Act (Sdu) and the online commentary module for General Administrative Law Act (Kluwer).

In 2016, Advocatenblad, a legal magazine published by the Netherlands Bar, selected Mark as one of the 35 most striking and ambitious young (under 35) lawyers in the Netherlands.

for the Royal Dutch Touring Club (ANWB) in a lawsuit claiming compensation under the Dutch Aviation Act for loss relating to the expansion of Lelystad Airport;

Advising and litigating

for AM Zeeland B.V. regarding a large housing development called the Noorderpolder Zierikzee project in the Municipality of Schouwen-Duiveland;

Providing regular advice

to hotel chain called “The Student Hotel” on various environmental, zoning and leasehold issues involving their Dutch hotel locations, as well as the development of new locations in the Netherlands;

Providing regular advice

to Van der Spek Uitvaart on zoning changes and permit procedures for the development and exploitation of new crematoria;

Advising and successfully assisting

Van der Spek Uitvaart in a tender procedure for the exploitation of an existing cemetery and the development of a new crematorium in the Municipality of Zwijndrecht (leasehold), including the drafting and negotiating all contracts;


Neptune Energy on environmental-law issues for its gas extraction in the North Sea;


Baker McKenzie as a co-counsel on the environmental, spatial planning and zoning aspects of major M&A transactions, including transactions for Deka Immobilien, W hotel Amsterdam, AMS Cargo Center at Schiphol Logistics Park, Cool63 Rotterdam, Blaakhaven and CitizenM Rotterdam;

Advising and successfully litigating

for NS Reizigers B.V. regarding authorisation permits issued by the State Secretary of Infrastructure and Environment for rail rolling stock;


the Municipality of Rijswijk on various real estate transformation projects (offices and housing);


the Municipality of Oud-Beijerland on fire-safety issues for healthcare related real estate;


holiday resort Citta Romana on zoning and environmental-law issues, also regarding the expansion of nearby holiday parks in the Municipality of Hellevoetsluis.
